If I am involved in an Accident with an Uninsured Driver, What Should I do?

Whether a person is insured or not does not determine what should be done at the scene of the accident. In every accident it is important to 1) take photographs, 2) get witness information, 3) get all driver’s involved personal and insurance information. Many people have insurance cards showing valid insurance, however, it is difficult to determine whether the insurance is truly valid until the insurance company is contacted and confirms coverage (this can take days). Therefore, your focus at an accident scene should be on collecting all the information possible.
As a trial attorney, I can tell you that photographs of the scene of the accident are critical at trial. Use your cell phone to take as many photos are you can. I recommend taking photos of the damage to both vehicles, the position of both vehicles at the point of impact (before the cars are moved), the surrounding area, the intersection, witnesses, and injuries. If you have the ability to take video on your phone, video the traffic light sequence (as this could be an issue at a later date). Please know that it is unlawful to record a person without telling them you are recording so I do not recommend attempting to record the at fault driver.
Ascertaining witness information is also critical. Many accident become “he said, she said” as to fault. If there are any witnesses get their name, address, phone number, and email address. In South Florida many people are here for only a few months and it can be incredibility difficult to locate witnesses months after an accident. The more information you get from the witness at the time of the accident the better.
